Statutory obligations and court orders

Statutory Orders areĀ made under any of the numerous powers contained in Acts of Parliament which give Her Majesty a power to make Orders.

The terrorism act 2000

It is a criminal offence to fail to disclose information that might prevent an act of terrorism or might bring justice to terrorists in the UK.

Court Orders

Disclosure may be ordered, involving the director having to attend court and bring notes and records with them.  They may be asked to produce a written report.  Refusal may constitute contempt of court.

Consent from the directee should ideally be sought.  According to legislation on Human Rights, GDPR and Freedom of Information, directees should have access to their reports unless there is cogent reason or public interest not to.
